Terms and Conditions

GENERAL
No addition to or modification of any of the Standard Terms and Conditions of Sale as they appear herein for component sales of the Seller shall be binding upon Seller unless signed in writing by a duly authorized representative of the Seller.

TERMS
Terms to customers of satisfactory credit are net 15 days from date of shipment. To avoid delay in filling orders, purchasers without previous experience with Seller should include credit information or references with their first order, remit cash or pay with VISA/MasterCard.

Amounts past due are subject to a service charge of 1 1/2% per month (or fraction thereof) in the event an account becomes past due. Buyer will be required to pay all costs of collection, including reasonable attorney’s fees.

ON NEW PRODUCTS
Manufacturers warranty applies on all new products. Please contact your sales representative for information.

ON REPAIRED PRODUCTS
The sale of Repaired Equipment shall be made upon the following terms and conditions. Any additional or different terms and conditions proposed by Customer will not be binding upon Precision Zone, Inc. (hereinafter "Company") unless specifically agreed to in writing by the Company's authorized representative.

EQUIPMENT COVERED
Unless otherwise stated, the Warranty shall cover All Repaired Equipment sold by Precision Zone, Inc., and specifically excludes Repaired Equipment sold "As-Is". The Company reserves the right to sell Repaired Equipment without a Warranty or under a Limited Warranty.

STANDARD WARRANTY PERIOD
Unless otherwise stated, the Standard Warranty Period shall begin on the Equipment Shipping Date and expires one hundred and eighty (180) days thereafter. Any change in the Standard Warranty Period shall be stated on the Customer Invoice.

The Company may offer Repaired Equipment for Sale under a Limited Warranty, whereby the Limited Warranty shall have a warranty period of thirty (30) days.

WARRANTY COVERAGE
The Company warrants the Repaired Equipment against defects in materials and workmanship, including all electrical and mechanical parts required for the proper and functional operation of the Repaired Equipment, unless otherwise stated below:

a. The Company shall, at its option either repair the equipment, supply a replacement (subject to availability), make a price adjustment or credit Customer's account upon an approved return of the equipment

b. ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE ARE SPECIFICALLY EXCLUDED AND DISCLAIMED.

c. The Company shall not be liable for any loss or damage whatever by reason of its failure to discover, report, repair or modify latent defects or defects inherent in the design of the equipment.

WARRANTY EXCEPTIONS
The Warranty SHALL NOT COVER ANY COSMETIC DEFECTS that do not affect the functional operation of the Repaired Equipment.

GUARANTEE OF WARRANTY SERVICE
Any repair made to the Repaired Equipment during a warranty period shall be guaranteed for thirty (30) days, but shall not act to increase the term of the warranty by more than thirty (30) days. An extension of the warranty period shall only cover the Repaired Equipment's functions or operations affected by the repair.

WARRANTY CANCELLATION
The Warranty shall be made void if upon the Company's inspection it is determined the Customer tampered with the equipment without authorization from the Company.

RETURNING EQUIPMENT UNDER WARRANTY
ALL Equipment covered by Warranty shall be returned to the Company in Accordance with the Company's Sales Warranty Procedure. The Customer is responsible for all Shipping, Handling, and Insurance Costs related to the shipping of the Repaired Equipment to the Company. The Company is responsible for all Shipping, Handling, and Insurance Costs related to the shipping of the Repaired Equipment to the Customer.

LIMITATION OF LIABILITY
The Company's liability on any claim of any kind, whether based on contract, warranty, tort, strict liability or otherwise, for any loss or damage arising out of or connected with or resulting from the supply of equipment hereunder, shall in no case exceed the price paid by the Customer to the Company for such equipment.

COMPLETE AGREEMENT
The terms and conditions contained herein represent the complete agreement between the Company and Customer, and no modification, amendment, revision, waiver or other change will be binding on the Company unless agreed to in writing by the Company's authorized representative.
